Privacy Policy

The “ Cultuur Academy ” Foundation supports cultural professionals in the Arnhem and Nijmegen region through grants, workshops, training sessions, and programs. We process your personal data in order to provide our services.

The “ Cultuur Academy ” Foundation processes your personal data in accordance with the General Data Protection Regulation (GDPR) and is responsible for processing your personal data in accordance with this policy. Below, we explain how we collect, use, and store your personal data.

What personal data is processed?

Cultuur Academy Foundation processes your personal data because you use our services and/or because you provide this data to us yourself. Personal data is information that can be used to identify you. This includes your name, place of residence, email address, phone number, or other information we need to provide our services to you. Depending on the nature of your request, registration, or participation, we may also process personal data other than contact information. The processing of your personal data involves, for example, the collection, storage, use, transfer, or deletion of your personal data.

In principle, the “ Cultuur Academy ” Foundation processes only the personal data that you yourself have provided to us. In addition, we may have obtained your personal data from other sources, such as the Chamber of Commerce’s trade register or public websites. If you participate in a training course commissioned by an organization or employer (an in-company training course), we will receive your data from that organization. If the organization recruits the participants itself, we process only the data provided by the organization and the contact person.

Below is an overview of the personal data we process or may process about you:

  • Name, address, and city (personal information);
  • Date of birth;
  • Phone number;
  • Email address;
  • IP address;
  • Web browser and device type;
  • Signature;
  • Bank account number and other payment information;
  • Information about the organization you work for and your position or role;
  • Information you submit when applying for a grant or participating in a selection process, such as your resume, portfolio, statement of purpose, and project or budget details;
  • Information regarding the review of your application or job application and related correspondence;
  • Information about your participation, such as registrations, attendance, and the balance on your punch card;
  • Your account information, such as your username, email address, an encrypted version of your password, and information about when you log in;
  • Information you provide to us when you subscribe to our newsletter, including your answers to questions about your background and the stage of your career;
  • Information from cookies and similar technologies, such as data about your activities on our website; and
  • Other personal data that you actively provide, for example, in correspondence and/or over the phone.

We hereby ask that you do not include any special categories of personal data in your application, resume, portfolio, or cover letter—such as information about your health, religion, or ethnic background—unless it is necessary for the evaluation process and we explicitly request it.

For what purpose do we process your data?

The “ Cultuur Academy ” Foundation needs your personal data to effectively carry out our fundraising activities, workshops, training sessions, and programs. We process your data only when it is necessary for the provision of our services. In some cases, the Cultuur Academy Foundation may also process your personal data even if you have not given your consent, provided there is a legitimate interest or a legal obligation to do so. In such cases, we will ensure that your right to privacy is not disproportionately infringed upon.

Cultuur Academy Foundation processes your personal data for the following purposes:

  • processing and evaluating your fund application, including by our external advisors;
  • informing you of the outcome of your request and corresponding with you regarding it;
  • disbursing a granted grant or loan and processing your bank information for that purpose;
  • entering into and performing the agreement with you, including the loan agreement and assessing whether the best-efforts obligation has been met and whether the loan will be converted into a gift;
  • reporting on the use of the fund's resources to our grant provider(s), the City of Nijmegen and/or the City of Arnhem;
  • processing your registration for a workshop, training session, program, or the Monday Club, including your punch card;
  • reviewing your application as part of the selection process for one of our programs, including by our external advisors;
  • processing your payment and sending invoices;
  • creating and managing your account and providing access to your personal dashboard;
  • securing your account and preventing misuse, for example, by detecting suspicious login attempts;
  • organizing and conducting meetings, including facilitating communication among participants (only with your consent);
  • respond to questions or requests you submit;
  • to provide information about changes to our services and procedures;
  • sending our newsletter (only with your consent) and tailoring the newsletter to your profile; and/or
  • to comply with legal obligations, such as our record-keeping and retention requirements.

We do not make decisions based on automated processing that have legal effects on you or significantly affect you. Requests and registrations are always reviewed by people. We use the categorization of newsletter subscribers solely to send you a more relevant newsletter.

On what legal basis do we process your data?

We need a legal basis to process personal data. We always process your personal data based on one of the following legal bases:

  • Your consent, for example, to receive the newsletter, to cookies on our website, to join a WhatsApp group, or to share your email address with other participants;
  • The performance of the agreement between you and the Cultuur Academy Foundation, or actions leading up to it, such as the processing of your application or registration;
  • A legitimate interest, such as the ability to effectively organize our activities, account for how we spend our resources, and secure our systems; or
  • A legal obligation, such as the tax retention requirement.

What security measures do we take?

The “ Cultuur Academy ” Foundation takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. We store your data in a single secure CRM system, where access is restricted to employees who need your personal data to perform their duties. In addition, we use Google Drive to allow one or more employees or external consultants to review portfolios and other documents related to the (fund) application. We enter into data processing agreements with the providers of the systems we use to ensure that your data is also properly protected there.

When is your personal information shared with third parties?

The “ Cultuur Academy ” Foundation does not share your personal data with third parties, unless it is necessary for the provision of our services or when we are required to do so by law or by a court order. This is never done for commercial purposes, unless you have given your explicit consent.

Your personal data may be shared in the following cases:

  • with the external consultants who evaluate your grant application or conduct the selection process for one of our programs. They receive only the information necessary for that purpose and have signed a confidentiality agreement;
  • with the Municipality of Nijmegen and/or the Municipality of Arnhem, if necessary for the accountability of the grant from which our funds are financed. In doing so, we do not share more information than is necessary for this purpose;
  • with the parties that support us in our business operations, such as the provider of our CRM system, our payment service provider, and our bookkeeper or accountant;
  • with other participants in a workshop, training session, or program—for example, by adding you to a WhatsApp group or by sharing your email address. We do this only with your consent; and
  • with judicial or government authorities, when we are required to do so.

How long do we retain your data?

The “ Cultuur Academy ” Foundation does not retain your data any longer than is necessary for the purpose for which it is processed. We are required to retain certain data for a specific period of time, and in doing so, we comply with the statutory retention periods.

We adhere to the following principles:

  • We retain administrative and financial records, including invoices and payment details, for seven (7) years in accordance with tax retention requirements;
  • We retain data regarding an approved grant application, contribution, or loan for up to seven (7) years after the project’s completion, repayment, or conversion into a grant, and thereafter for as long as necessary to fulfill our reporting obligations to our funding provider;
  • We retain data from a rejected grant application or an unselected submission for up to two (2) years after the decision, unless there is another purpose or legal basis for retaining it longer;
  • We retain information about your participation in a workshop, training session, or program for up to two (2) years after it ends;
  • We will retain your information as a subscriber to our newsletter until you unsubscribe.

What are your rights?

Cultuur Academy You can submit a request if you wish to:

  • (make someone) realize;
  • (have) modified, for example, to correct inaccuracies;
  • (have) filled in;
  • (have it) removed; or
  • (to) transfer.

In addition, you have the right to restrict the processing of your data or to object to it. You may also withdraw your consent to the processing of certain personal data at any time, without this affecting the lawfulness of any processing that took place prior to the withdrawal. You can unsubscribe from our newsletter at any time by clicking the unsubscribe link at the bottom of the email.

Do you have a complaint?

You can contact us at info@cultuuracademy.nl for:

  • a request to access, correct, delete, or transfer your personal data;
  • withdrawing your consent;
  • objecting to the processing; and
  • Any other questions or complaints regarding the processing of your personal data.

You can expect a response from us within four (4) weeks. The Cultuur Academy Foundation would also like to inform you that you have the option to file a complaint with the national supervisory authority, the Dutch Data Protection Authority. You can do so via this link.

Changes to This Policy

Regulations governing privacy and data protection law are still evolving. We strive to keep this privacy policy as up-to-date as possible and may therefore amend it.
