Tax advantages for an ANBI
If your institution has ANBI status it offers several tax advantages. The main advantage is that you do not pay taxes on inheritances or donations that you receive and use for your nonprofit activities. In addition, you are eligible for tax refunds on the use of energy. ANBI status also offers benefits to people or organizations who want to make a donation or sponsor you in some way. When do you qualify for ANBI status?
You can't just become an ANBI because the main requirement is that your institution is almost entirely dedicated to the common good - read a social interest. Often, associations and clubs focused on a specific hobby are not ANBI but can obtain the characteristic of socially beneficial institution (SBBI). In that case, you still have various tax benefits, mainly related to gift and/or inheritance tax.
Terms
Besides the fact that you are working for a common good, you are not allowed to have a profit motive in the elaboration of your initiatives or projects. In addition, you have a number of administration obligations, each person involved is expected to have a clean slate, and the like. Cultural ANBI
If at least 90% of your initiatives or projects take place in the cultural field, you can, if you have ANBI status, be designated as a cultural ANBI. People or companies who want to support you through donations or sponsorships will also have tax advantages. Therefore, always mention it in your sponsorship proposal and/or through other means of communication that you use.
How do you become an ANBI?
The Internal Revenue Service is the party that determines whether you actually qualify for ANBI status. They have prepared a form that you can download, print and fill out before submitting it. On the form you can also indicate whether you want to be considered a cultural ANBI.
Obligations for an ANBI
It is very important that you keep the Tax Office well informed of any developments that may relate to ANBI status. If you no longer meet all the conditions then you may lose this status and the Inland Revenue has the right to institute this retroactively. This can be a big bummer, so be open and honest and contact the Tax Office when in doubt. In addition, you have some form of publication obligation of data and financial situation.
